Terms of Service
These Terms of Service (“Terms”) govern access to fimmer.com and related Fimmer services (the “Service”). By using the Service you agree to them.
They describe the product as it works today. They are not legal advice. If you do not agree, do not use the Service.
The Service
Fimmer helps you follow public-company news and related signals. We cluster coverage, link to original stories, and display scores such as significance, sentiment, environment, social, governance, sustainability, and overall impact. Optional paid features may include a personalised feed, saved articles, watchlists, trends, activity, and RSS.
We may change, suspend, or discontinue features, coverage universe, scoring methods, or data sources at any time.
Not financial advice
Fimmer’s content and impact scores are for general information only and are not financial, investment, tax, or legal advice. They are not a recommendation to buy, sell, or hold any security. You are responsible for your own decisions and should use independent professional advice where needed.
Scores are model outputs based on news and other third-party data. They can be wrong, delayed, incomplete, or revised. Original articles remain the responsibility of their publishers. Links to third-party sites are not endorsements.
Accounts
Some features require an account. You must provide accurate details, keep your password confidential, and are responsible for activity on your account. You must be able to form a binding contract (in Australia, that generally means 18 or older).
We may refuse, suspend, or close accounts that breach these Terms, look abusive, or present a security or legal risk.
You may delete your account in settings. Deletion removes access to paid features. Fees already paid are handled under Fees and refunds below.
Paid plans
Paid access may be sold as a subscription (monthly or annual) or a lifetime / limited-time deal, as shown on the pricing page at the time of purchase. Features included in each plan are described on the site and may change.
- Checkout and billing are processed by Stripe.
- Subscriptions renew until you cancel through the billing portal or as otherwise offered in the product.
- Lifetime deals, if offered, grant access to the stated plan features for as long as Fimmer operates that product, subject to these Terms. They are not a guarantee that every current feature will exist forever.
- We may introduce new paid tiers or change prices for future purchases. Existing subscriptions stay on their current Stripe price until you change plan or the subscription ends.
Taxes may apply depending on your location and Stripe’s collection.
Fees and refunds
Unless a longer period is required by law, we offer a 14-day refund window on eligible paid purchases, consistent with the guarantee shown on our pricing page. After that, subscription fees are generally non-refundable except where we choose to refund or the law requires it.
To request a refund, email contact@fimmer.com. Chargebacks filed without contacting us first may lead to account suspension.
Acceptable use
You agree not to:
- Scrape, bulk-download, or republish Fimmer scores, summaries, or clustered news except as we expressly allow (for example your own RSS feed token for personal reading)
- Misuse another person’s account or attempt to break authentication or payment flows
- Overload, probe, or disrupt the Service
- Use the Service to provide competing scored-news products to third parties without our written permission
- Misrepresent Fimmer output as regulated investment research or as your original reporting
- Upload or transmit malware, or use the Service for unlawful activity
We may rate-limit, block, or terminate access if we believe these rules are broken.
Intellectual property
Fimmer, our branding, software, layout, scoring presentation, and original compilation of the Service are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your own internal or personal use while these Terms apply.
News headlines, article text, and publisher logos belong to their respective owners. Company names, tickers, and marks belong to those companies. We display them to identify public issuers and sources.
Feedback you send us (including bug reports) may be used to improve the Service without obligation to you.
Privacy
Our Privacy Policy explains how we handle personal information. Using the Service means you also accept that policy.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SCORES, SUMMARIES, TIMELINES, FINANCIAL SNAPSHOTS, OR NEWS CLUSTERS ARE COMPLETE, CURRENT, OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED.
If Australian Consumer Law or similar rules give you non-excludable rights, those rights still apply. Our liability for a failure to comply with such a right is limited, where permitted, to resupplying the Service or paying the cost of resupply.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FIMMER AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR TRADING LOSSES, ARISING FROM THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD, OR AUD $100 IF YOU HAVE PAID NOTHING.
Indemnity
You will indemnify Fimmer against claims, damages, and reasonable costs arising from your misuse of the Service, your content or feedback, or your breach of these Terms, except to the extent we caused the harm.
Changes to the Terms
We may update these Terms by posting a new version on this page and changing the “Last updated” date. Continued use after the change constitutes acceptance. If you do not agree, stop using the Service and cancel any subscription.
Governing law
These Terms are governed by the laws of Victoria, Australia. Courts in Victoria have exclusive jurisdiction, except that we may still seek injunctive relief anywhere to protect the Service.
If a provision is unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement between you and Fimmer for the Service.
