The High Court issued its quantum judgment in Swatch Group’s trade mark dispute with Samsung over watch face apps offered on the Samsung Galaxy App store between 2015 and 2019. The court said damages should be assessed prospectively, without hindsight, and negotiation damages reflect loss of control. Samsung must pay Swatch Group US$11.6m.
