Progressive Express Insurance Company filed a declaratory judgment suit in federal court in Houston asking a judge to rule it owes nothing on a claim tied to a US 290 crash in Harris County. The complaint says a tractor-trailer swerved to avoid a wreck and hit a concrete barrier on Sept. 15, 2023, but the vehicle and driver involved were not listed or reported under the policy. Progressive also argues an MCS-90 endorsement does not apply.
