The Federal Trade Commission asks a U.S. appeals court to reject Amgen’s argument that its acquisition of exclusive Enbrel patent applications is antitrust-immune. The FTC says Amgen used patents and permanent injunctions to block Sandoz and Bioepsis biosimilars, prolonging Enbrel’s market exclusivity and preventing lower-cost competition.
