FCC Orders Outside Expert Arbitration for AT&T-Duke Pole Rate Dispute
FCC said AT&T and Duke should use an outside expert arbitration panel under their 1978 contract to resolve a pole-attachment disagreement. The agency noted the arbitrators could require additional filings and pointed to the contract terms that set rental rates. AT&T said Duke charged multiple times the FCC-capped rate in the Carolinas, while the dispute remains ongoing.
