ERISA Group Urges 2nd Circuit to Uphold WPP Forfeiture Suit Dismissal

In Polanco v. WPP Group USA Inc. et al., plaintiffs sought to represent WPP employees in the plan since 2018 over use of plan forfeitures. An ERISA Industry Committee amicus urged the U.S. 2nd Circuit to affirm dismissal, arguing most forfeitures were used to offset WPP’s upcoming contributions as allowed by the plan and federal regulations. Plaintiffs filed more complaints in 2025 than 2024.
