Court Partially Revives Eli Lilly Suit Over Weight-Loss Drug Practices
U.S. District Judge Jacqueline Scott Corley partially granted Eli Lilly’s effort to press its case against Aequita Pharmacy and Aequita Corporation, finding Lilly plausibly alleged a conspiracy to violate California’s Unfair Competition Law through corporate practice of medicine. The ruling dismissed Lanham Act claims, including parts of the false-advertising theory, while crediting allegations linking Ahmad’s control and incentives to the challenged prescription-filling practices.
