California Alleges DuPont Used Spin-Off Restructuring to Evade PFAS Liability
DuPont and three spin-off companies are accused by California attorney general Rob Bonta of using a corporate restructuring scheme to avoid per- and polyfluoroalkyl substances (PFAS) liability. Bonta alleges the plan violates state fraudulent transfer laws by shifting most liabilities onto Chemours, while limiting liability for Corteva, New DuPont and Qnity. If successful, other states could file similar claims.
