Appeals Court Upholds Gilead Injunction Blocking Imported HIV Drug Sales
The US Court of Appeals for the Fourth Circuit upheld a preliminary injunction barring defendants from importing or facilitating the sale of foreign-market, Gilead-branded HIV medications in the US. The court found differences between the US and imported versions were material. The restriction has been in effect throughout the appeal after the injunction was expanded to additional sellers, including CanaRx, ElectRx, and ScriptSourcing.
