A US Court of Appeals for the Seventh Circuit affirmed dismissal of a proposed class action against Samsung, ruling plaintiffs did not plausibly allege Samsung gained or exerted control over biometric data on users’ devices as required under Illinois’ BIPA. The suit claimed a pre-installed phone app scanned self and others’ photos using face-tagging.
