American Express waived its right to compel arbitration of disputes with a group of small merchants after failing to pay required administrative fees to the American Arbitration Association. Merchants challenging alleged excessive AmEx swipe fees and contract terms limiting encouragement of cheaper cards had their cases warned they would be administratively closed if fees weren’t paid by Feb. 26, 2024.
